By Laws


With every registered Strata Plan there are a set of By Laws that apply which regulate how the Strata Plan and the people living within. When a Lot Owner or Owners Corporation wish to make certain changes, in particular to common property, the legislation usually requires a By Law be presented at a general meeting and once passed be registered on the Certificate of Title for the Strata Plan.


We have drafted By Laws for Owners Corporations and Lot Owners for a variety of reasons, such as:


  • Renovations to Lots which involves replacing certain common property, such as tiling, window frames, plumbing and the like

  • Installation of air conditioning units

  • Exclusive Use By Laws

Building Defect Claims


With changes to the Home Building Act it is the very important that building defect claims are dealt with time and cost efficiently.  It is also vitally important that the lawyers involved are aware of the commercial realities of the situation, the effect legal costs have on owners, as well as get their building repaired as soon as possible.

Fair Trading mediations/CTTT applications


Some disputes cannot be resolved between the parties and it is sometimes it is necessary to involve a third party.


Applications can make an applicaiton for mediation at Fair Trading.  Usually mediation can solve the issues between the parties and give an outcome acceptable to all parties.


When mediation fails, an application for an Order from the Adjudicator can be sought.  Most of the time this does not require a hearing, rather it is dealt with each parties submitting written submissions.
